The driver was pulled over on SW Archer Road for having a window tint that appeared to be darker than the legal limit, and for failing to drive within a single lane. Upon being stopped, the driver had difficulty walking over to the officer’s patrol vehicle. The officer determined that the window tint was 25%; moreover, he noticed that the driver smelled strongly of alcohol. The driver claimed he had only consumed one drink that night, but agreed to perform field sobriety exercises. He performed poorly on the exercises, and was subsequently arrested for DUI. (Date of Arrest: April 8, 2011)

Upon agreeing to take a breath test, the driver blew .143 and .142. Attorneys at Meldon Law assisted the driver with admission into the Deferred Prosecution program, which required him to perform community service hours, attend DUI school, and pay fines. After his successful completion of the program, the driver attained the lesser charge of Reckless Driving with Alcohol.
