A Gainesville Police Department officer observed a driver swerving into the bike lane. She also rolled through a red light upon making a right-hand turn. The officer initiated a stop and noted the driver’s unsteadiness, bloodshot eyes, and slurred speech. The driver admitted to having four beers prior to driving but agreed to field sobriety exercises. The officer claimed she performed “poorly.” Upon her arrest, she provided breath samples of .138g/210L and .142g/210L.

The State sought an adjudication of guilty for DUI, complete with 12 months of probation, fines, community service, and DUI school. However, attorneys at Meldon Law assisted the driver with pleading to the lesser charge of DUI above .08g/210L but below .15g/210L. Additionally, after completing ½ of her probationary period, attorneys successfully moved for early termination of probation.
