A driver was observed driving erratically and failing to maintain a single lane. He then attempted to enter an apartment complex, but fell upon exiting his vehicle. Responding Gainesville Police Department officers made contact with the driver, who appeared confused and admitted to having consumed a significant amount of alcohol that evening. He refused to cooperate with law enforcement, and became hostile with law enforcement. Field sobriety exercises were not attempted and the driver was arrested. He provided two breath samples of .223 and .232.

He retained Meldon Law and pled to the DUI charge. However, he was able to attain early termination of probation upon receiving an out-of-state job offer.
