A driver was observed traveling in the wrong direction on the highway, stopping on the shoulder, and then driving with part of his vehicle in a turn lane. An officer with the Alachua County Sheriff’s Office initiated a stop and had to request the driver to exit his vehicle four times before the driver complied. The driver was very combative and the officer noticed that he was unsteady, smelled of alcohol, and had watery and bloodshot eyes. A passenger in the vehicle informed law enforcement that the driver had been drinking earlier that day.

The driver refused to perform field sobriety exercises and was arrested for DUI. He admitted to having consumed three or four beers that day and informed law enforcement that he also took blood pressure medication. He was read implied consent multiple times and consented to a breath test. He provided samples of .198g/210L and .190g/210L.

After hiring Meldon Law, the driver pled to the non-enhanced charge of DUI above .08g/210L but below .15g/210L.
