DUI and Criminal Defense

A policeman initiated a traffic stop on a vehicle that was stopped beyond the stop bar at a traffic signal. During the stop, the officer noticed a strong odor of alcohol and after being asked the driver admitted to consuming “two or three beers” prior to driving. The driver agreed to perform Standardized Field Sobriety Exercises, but stumbled on the way out of the vehicle and was unable to successfully complete any of the exercises.

The driver was arrested for DUI and brought to the Alachua County Jail where he submitted to a breath test and twice blew .174g/210L and .164g/210L. The driver was admitted into the DUI Deferral Program. The deferred prosecution program reduces the charge of DUI to reckless driving with alcohol upon completion.
