Alachua County Driver Pulled Over for Failure to Maintain a Single Lane

A Gainesville Police Officer was traveling north on NW 13th St when he observed a White GMC truck driving northbound as well. While following the vehicle the officer noticed that the vehicle crossed the left lane marker two times and then while turning onto NW 6th St, the vehicle drifted to the right as it turned left. The Officer conducted a traffic stop on the vehicle and spoke with the driver. While speaking with the driver the officer noticed bloodshot eyes, slurred speech and there was an odor of alcohol coming from the vehicle. Based on this the Officer requested a fellow Officer respond to the scene to conduct a DUI investigation. When the second officer arrived, he requested that the driver perform field sobriety exercises, which the driver refused. The driver was then placed under arrest for driving under the influence and transported to the Gainesville Police Department where he was requested to provide a breath sample, which the driver refused to provide.

The driver hired Meldon law. The attorneys at Meldon filed a motion to suppress based on a lack of probable cause and lack of reasonable suspicion to conduct the traffic stop and had a suppression hearing. After the hearing, the motion to suppress was granted and ultimately the charges against the driver were dropped.
