Gainesville Driver’s DUI Charge Reduced

A Gainesville Police Department officer responded to the area of 2700 W. University Avenue regarding a traffic crash. The driver of one of the involved vehicles had left the scene and was located at 3500 NW 1st Court. When officers arrived, witnesses identified the driver as the operator of the other vehicle involved in the crash. As officers spoke with him, they observed him have some difficulties maintaining his balance as well as other indicators of impairment.

The Arrest

The driver was asked the driver to perform field sobriety exercises, which the driver agreed to do. The first exercise was the horizontal gaze nystagmus, during which the officer stated they observed distinct and sustained nystagmus at maximum deviation in both eyes. The officer also observed 4 out of the 8 impairment indicators on the walk and turn exercise and 3 out of 4 impairment indicators on the one-leg stand. Based on the driver’s performance, he was placed under arrest and asked to provide a breath sample that the driver agreed to provide. The results of the breath test were .098 and .099.

The Solution
