Appellate Court Upholds Florida Law Capping Medical Malpractice Awards

On May 27, 2011, the 11th Circuit Court of Appeals in Atlanta, Georgia handed down a significant ruling regarding medical malpractice claims filed in Florida.

 

More specifically, the higher court held that a Florida law (Fla. Statute sec. 766.118), which places a monetary cap on certain medical malpractice damages a plaintiff may receive, is valid and constitutional.

 

The Florida Legislature passed the "cap" law in 2003.  The law limits the amount of non-economic damages (such as pain and suffering) that may be awarded to a plaintiff at $500,000 per defendant, which may include doctors, hospitals, and medical practices. Economic damage awards, however (such as past and future lost wages and medical and rehab expenses), remain uncapped.
