Vehicular Homicide Illustrated

Local accident lawyer, Jeffrey Meldon, gives some illustrations of past and current Florida vehicular homicide convicitons in this article. A driver may be charged with vehicular homicide when they operate their vehicle in a foreseeably reckless manner and kill another person.

Here are some examples of past convictions (71 Dec. Fla. BJ 46 (1997)):

  • Killing a bicyclist when the driver was recklessly weaving in and out of traffic;
  • Killing the driver of oncoming car while speeding and passing on a hill in rainy weather;
  • Driving at a high rate of speed in a "Slow-Children at Play" zone and killing a 5-year-old child.
  • Killing a viable fetus by causing injury to a mother when the fetus is capable of life outside the womb with standard medical care. ((F.S. 781.072(2008))

Here are some examples of current charges:

  • Killing an 11-year old passenger, who was improperly restrained in the driver's front seat in violation of Florida's Safety Belt Law, in a single vehicle accident that also caused minor injuries to two other children, under the age of 3, who were improperly restrained.
  • A 18-wheel semi-truck driver, who has not had enough sleep in 40 hours and may have been using a cell phone, slams into the rear of a properly stopped school bus, killing one child and causing the bus to burst into flames.
