After PIP runs out, then the driver’s Bodily Injury Liability (BI) would kick in for further medical expenses for the rider, as the driver was at fault. If the driver had no BI, and most don’t, the rider’s Uninsured Motorist Coverage (UM) would come into play. What if the rider of the horse was shown to be at-fault in this accident? From the information regarding this accident, the driver of the vehicle most likely caused the accident. If however, just for the sake of insurance discussion here, the rider was negligent, the rider’s General Liability Coverage on his Home Owner’s policy could be used, unless there is an exclusion on the policy.
