
Recently I posted a blog on Injury Board, which is a nationwide group of distinguished lawyers concerned with issues regarding public safety and public awareness, that I am proud to be a member of.
In short, the blog consisted of alerting readers to the recent Insurance Research Council (IRC) statement that one in four drivers on the road today in Florida is driving illegally, without any insurance. This creates a potential crisis for a motorcycle rider, or biker, that has the bad luck of being crashed into by one of them. The Florida repeal of the Universal Helmet Law in 2000 creates an additional hazard for bikers riding without helmets. This is a topic that I find to be extremely frightening and interesting. I would like to share with you one response I received so far from this blog, as I find this a very important point to get across. Here it is:
"I found this example interesting.
"A 'lucky' motorcycle accident victim is one that is fortunate enough to be hit by a fully insured vehicle driver."
Motorcyclist, or actually "Bikers" who are not going to ware a helmet because they feel helmets add to the danger of riding and inhibit the purpose for riding are not going to spend the money for additional insurance. It just isn't going to happen.
If you don't feel you need a $200.00 helmet you damn sure won't feel you need a $1,000,000 insurance policy.
While you may be totally honest in your "concern" for the biker, you'll sell more insurance to the people who are under insured and driving automobiles, and, you'll help those "lucky" bikers they run into."
What I would like to point out about this blog comment, is that I don't sell insurance, I am an experienced Florida accident lawyer (38 years of experience) that does all I can to help accident victims, who through no fault of their own get seriously injured or killed in accidents.
It may seem confusing to many listeners or readers why I, an accident attorney and not an insurance salesman, frequently talk and write about making sure they are adequately insured and protected. So I will take this opportunity to clarify my rational for "selling" insurance. In short, if the money/insurance isn't there on a client's/victim's part or on the at-fault party's part, there just isn't any money to pay for: medical bills (past and future), loss of income (past or future), or pain and suffering (past and future), that can result from a serious accident. A person in this situation is just plain out of luck and it can be a heartbreaking, devastating situation for the victim and their family... no matter the skill or expertise of the lawyer they hire!
For me, my emphasis on educating the public on the importance of carrying adequate insurance protection and what adequate insurance consists of, is akin to a Doctor warning their patients of the dangers of smoking or to a parent warning their child to look both ways before crossing the street; it is important and valuable information to have.
You may choose to go uninsured or underinsured, however, beware, if you have the unfortunate experience of being in an accident, my experience has shown that you may very likely wish you had paid the price of the insurance instead of paying the price of going with the minimal or inadequate insurance, especially in these economic times.
