Failure to Wear a Seat Belt Might Soon Become a Primary Offense in Florida

Currently, failure to wear a seatbelt by anyone over 18 years old is a secondary offense in Florida. This means that a law enforcement officer cannot pull over a vehicle solely because its driver is not wearing a seatbelt. A driver can receive a ticket for failure to wear a seatbelt, but only if he or she is pulled over for another (primary) offense. This may soon change due to House Bill 1.

According to the National Highway Traffic Safety Administration (NHTSA), the states which passed a primary enforcement of the seatbelt law experienced a drastic increase in seat belt usage. For example, in Alabama, the seatbelt usage  rate increased by 21% after the legislature passed a similar law. The American Automobile Association (AAA) estimates that 124 lives would be saved and more than 1,700 serious injuries would be prevented in Florida in the first year after the passage of the seatbelt law as a primary offense.

Always wear a seat belt when you are in a vehicle, and make sure that others do the same. It may save your life or the life of a loved one or friend.
