As an experienced Clay County accident attorney, it appears both teens were in violation of Florida's Safety Belt Law, in the recent pick-up truck accidenet near Green Cove Springs on S.R. 17; Nettles, the driver, failed to wear his seatbelt and Buckhalter, under 18 years of age, rode unrestrained in the bed of the pick-up truck.
Florida law requires the driver and any front seat passenger under the age of 18 to wear a safety belt. Additionally, minors under 18 years of age are required to wear a safety belt-no matter where they ride in a vehicle.
Not only are teen drivers ages 15 to 19 more likely than any other age group to be involved in a motor vehicle accident, but rural pick-up drivers are less likely to comply with safety belt laws. Although Nettles and Buckhalter fall into both high risk categories, violation of safety belt laws continues to be merely a secondary offense.
